In this action, the plaintiff, 17 year-old student suffered permanent jaw and facial injuries when the driver of a minivan lost control as he came around a curve and struck the school bus the plaintiff was riding in. Plaintiff was thrown forward and hit her head and jaw on a metal bar on the seat in front of her. Plaintiff was then thrown backward and struck the back of her head on the seat behind her, which had a metal bar in the upholstery. Plaintiff suffered ripped joints and torn ligaments, tendons and muscles in her jaw. Plaintiff was treated by 10 doctors before she was correctly diagnosed with TMJ dysfunction. Plaintiff was fitted with an appliance, but still continues to suffer severe and progressively worsening pain throughout her life. To combat the pain, Plaintiff must take medication and periodically gets topical anesthetic injections in her face using 4-inch-long needles. The verdict in O'Neil vs. Critchley was set aside by the trial judge for being excessively high in relation to the injuries sustained by the plaintiff.

Plaintiff sustained serious permanent injuries after his car collided with a furniture delivery truck that skidded on wet pavement and fell onto Plaintiff s vehicle. It took rescuers 45 minutes to remove plaintiff from the wreckage. Plaintiff remained in a coma for two days and hospitalized for 90 days with a shattered pelvis and head trauma. Plaintiff pelvis was reconstructed with screws and plates, and one leg now is an inch shorter than the other. Plaintiff experienced memory loss, difficulty concentrating, outbursts of anger, panic attacks and a seizure.

In this action, the plaintiff, a 30-year-old UPS driver making a delivery to the loading dock at the defendant's premises, contended that a ladder that was affixed to the loading dock was loose, and detached as he was climbing up. The plaintiff fell approximately four feet, twisted his back and fell onto his legs. The plaintiff suffered a severe herniation at L-5, S-1 that required four surgical interventions and will permanently cause disabling pain.

This was an action involving a plaintiff, age 50 at the time, who was driving a car owned by his employer. The plaintiff contended that the defendant driver and the unidentified driver of a second vehicle were drag racing in the same direction as the plaintiff was traveling, resulting in the defendant losing control and striking the plaintiff, propelling him into a utility pole. The plaintiff suffered facet fractures at C-3 and C-4, which required a fusion after an unsuccessful surgical course. The plaintiff maintained that the fusion placed extensive pressure on the areas above and below the fusion, occasioning severe radiating pain, that he developed a very substantial kifosis and that he required subsequent surgery in which a large portion of bone was removed from three cervical levels and replaced with inter-vertebral prostheses and titanium mesh at the three cervical levels. The defendant driver settled early on for his $100,000 policy limits. The employer's commercial policy had $1,000,000 UIM coverage and the policy provided for binding arbitration.

Plaintiff sustained serious second- and third degree burns to his arms, legs and torso when a spark ignited butane gas at a lighter-manufacturing plant. While on the job, plaintiff observed a leak in one of the plant’s butane gas line filter housings. This was an action involving a plaintiff age 17 at the time, who was a passenger in her boyfriend's car. The plaintiff contended that the defendant host driver negligently made a left hand turn into the path of the on-coming driver and that the co-defendant non-host driver was traveling too rapidly and failed to make adequate observations. The plaintiff sustained bilateral compound comminuted ulnar fractures and compound comminuted fractures to the mid-shaft of the right humerus. The plaintiff maintained that she will suffer permanent restriction and very noticeable scarring on her forearms. The plaintiff further contended that she struck her head on the windshield, suffering a close head injury, which caused a relatively moderate cognitive deficit that ultimately resolved as well as a relatively slight scar above one eye.

In this action, the female plaintiff driver, age 32 at the time, contended that the defendant negligently struck her in a rear-end collision. The plaintiff maintained that the impact was very substantial and that she sustained a herniated disc at C-6-7, which required an anterior fusion. The plaintiff contended that surgery resulted in excessive stress being placed on the level above the fusion. The plaintiff contended that this pressure resulted in a small herniation in the adjacent level. The plaintiff also contended that she suffered a concussion, which caused short-term headaches and a cognitive deficit which essentially resolved with cognitive therapy from a neuropsychologist. The plaintiff further maintained that she suffered slight, but noticeable scarring above the eye. Finally, the plaintiff contended that she suffered two fractured ribs, which resolved.

This was an action in which the male plaintiff pedestrian in the parking lot of the non-party supermarket contended that after the defendant driver missed an open parking space; she traveled in reverse quickly and without making proper observations in order to obtain a different parking spot in the crowded lot. The plaintiff contended that as a result, he was struck and knocked to the ground, suffering a lumbar compression fracture and an aggravation of previously asymptomatic lumbar degenerative disc disease. The plaintiff, who had worked as a teacher in the use of heavy equipment for many years, contended that he could not continue the heavy, practical aspects of his job and that after approximately one year in which others would cover for him in this aspect while he continued the classroom duties, he was advised that unless he could resume the physical aspects, he would lose his job. The plaintiff maintained that he could not continue. The plaintiff also contended that he would have enjoyed a very active retirement and must now lead a much more sedentary lifestyle.

In this action, the female plaintiff, in her early fifties at trial, contended that the defendant bank negligently failed to salt the sidewalk in front of the bank despite recurring freezing and thawing conditions which had occurred in the four day period preceding the fall and subsequent to a heavy snow storm which fell one week earlier. The plaintiff contended that as a result, she slipped and fell after she had exited the bank, suffering a trimalleolar fracture.

The female plaintiff driver, age 32 at the time, contended that the defendant failed to stop at a stop sign, causing the collision. The plaintiff contended that as a result, she suffered fibromyacitis in the cervical spine and soft tissue lumbar sprains and strains, which will cause permanent pain and restriction. The defendant contended that she looked before proceeding and did not see the plaintiff, arguing that it was likely the plaintiff was speeding. The plaintiff denied that she was speeding. The defendant also maintained that his view was partially obstructed by a hill and curve in the roadway. The plaintiff introduced photographs, which the plaintiff maintained contradicted this defense contention.

The Board supplied the 55-gallon drum into which cooking grease was poured, negligently failed to provide a cover and that the co-defendant cafeteria services company negligently continued pouring oil into the uncovered drum, resulting in it overflowing when it rained.
