Contested vs. Uncontested Divorce in New Jersey

A contested divorce is one in which the parties cannot agree on the terms of their divorce such as the division of assets, allocation of debt, alimony, child support, or the custody of children.  A contested divorce case can be a long, involved and emotionally draining experience.  However, be assured that the attorneys at Schibell Mennie & Kentos  will meet all of your inquiries with genuine concern for your family’s welfare and complete confidentiality.  We will also help you understand the legal process, gather the requisite discovery and vigorously present your position to the Court.

In an uncontested divorce the spouses agree on everything and do not need the court to divide assets or make determinations about alimony, child support or custody. In general, an uncontested divorce will proceed through the system more quickly, be much less complicated, and less of a financial burden.  The attorneys at Schibell Mennie & Kentos can assist you in drafting uncontested divorce Marital Settlement Agreements and will make sure that you have considered and addressed all possible issues.
